Agreement to Terms

By accessing or using Birrday, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

Description of Service

Birrday is a birthday tracking and reminder service that helps you remember important dates for friends and family. Our services include:

• Birthday tracking and calendar management
• Email and SMS reminder notifications
• Birthday wish sending on your behalf (Pro feature)
• Facebook birthday import (via browser extension)

Account Registration

To use Birrday, you must:

• Be at least 13 years old
• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

Free and Pro Features

Free Features

• Add up to 1,000 friends and birthdays
• Day-of birthday reminders (push notifications)
• Calendar view and management
• Basic reminder functionality

Birrday Pro

Pro unlocks premium features including multiple reminder options, custom notification times per friend, email/SMS notifications, Facebook birthday import, and priority support.

Pricing tiers:

• Early Bird Lifetime ($19 one-time) - Limited to first 100 customers
• Annual Subscription ($19/year) - Available after early bird sells out
• Lifetime License ($99 one-time) - Available after early bird sells out

Lifetime License Terms

"Lifetime" refers to the operational lifetime of the Birrday service, not the lifetime of the purchaser. By purchasing a lifetime license, you acknowledge and agree to the following:

• Service Lifetime Definition: Your license remains valid for as long as Birrday continues to operate the service in its current or substantially similar form.
• Feature Scope: Lifetime access includes all Pro features available at the time of your purchase. Major new features introduced after your purchase may be offered as separate add-ons or included at our discretion.
• Fair Use: Lifetime licenses are for reasonable personal use, limited to one account with up to 1,000 tracked friends. Commercial use, resale, or excessive automated usage is prohibited.
• Non-Transferable: Your lifetime license is personal and cannot be transferred, sold, or shared with others.
• Service Modifications: We reserve the right to modify, update, or improve the service. If we make material changes that significantly reduce functionality, lifetime users will be offered a prorated refund option.
• Service Discontinuation: In the unlikely event we discontinue Birrday, we will provide at least 90 days notice and offer data export functionality. No refunds are provided for service discontinuation occurring more than 2 years after purchase.
• Long-term Sustainability: After 10 years from your purchase date, we reserve the right to convert lifetime licenses to a complimentary annual subscription (renewed automatically at no cost) to ensure service sustainability.

Payments and Refunds

All payments are processed securely through Stripe. By making a purchase, you agree that:

• Lifetime purchases: One-time payments are eligible for a full refund within 14 days of purchase if you have not used Pro features extensively. After 14 days, refunds are at our discretion.
• Annual subscriptions: Can be cancelled at any time. Cancelled subscriptions remain active until the end of the billing period. No partial refunds for unused time.
• Referral credits: Discounts earned through referrals are non-transferable and expire if not used within 12 months.
• Price changes: We reserve the right to modify pricing at any time. Existing lifetime license holders and active subscribers are not affected by price increases.
• Early Bird pricing: The $19 lifetime early bird offer is limited to the first 100 customers and cannot be combined with other promotions.

Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Send spam, unsolicited messages, or harassing content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Impersonate others or provide false information
• Use automated tools to scrape or extract data
• Violate the rights of others

Content and Data

You retain ownership of the content you create (friend data, notes). By using Birrday, you grant us a limited license to store and process this data to provide our services.

You are responsible for ensuring you have the right to store and use any personal information about others that you add to Birrday.

Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or security reasons. We are not liable for any damages resulting from service interruptions.

Limitation of Liability

To the maximum extent permitted by law, Birrday and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to missed birthdays, failed notifications, or loss of data.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free or that notifications will always be delivered on time.

Account Termination

We may suspend or terminate your account if you violate these terms or engage in abusive behavior. You may delete your account at any time through the settings page. Upon termination, your data will be deleted as described in our Privacy Policy.

Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the service after changes constitutes acceptance.

Governing Law

These terms are governed by the laws of the jurisdiction where Birrday operates. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
